Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Hook Creative Studio Pty Ltd (ABN 66 670 923 958), a company registered in Victoria, Australia ("Company", "we", "us", or "our"), governing your access to and use of the HOOKiQ platform located at hook-iq.com ("Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

2. Description of Service

HOOKiQ is an AI-powered social media replication platform that enables users to upload documents, generate AI personas, replicate social media discussions, and receive predictive reports. The Service uses third-party large language model (LLM) providers to generate content.

3. Account Registration

To access the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorised use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Generate personas or simulations intended to harass, impersonate, or deceive real individuals
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Violate any applicable local, state, national, or international law

5. Uploaded Content

You retain ownership of all documents and data you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive licence to process, store, and analyse your content solely for the purpose of providing the Service.

You represent and warrant that you have all necessary rights and permissions to upload and use your User Content, and that your content does not infringe upon the intellectual property rights of any third party.

6. AI-Generated Content

The Service generates content using artificial intelligence, including persona profiles, simulated discussions, and reports ("Generated Content"). You acknowledge that:

  • Generated Content is produced by AI models and may not be accurate, complete, or reliable
  • Generated Content does not represent the views or opinions of Hook Creative Studio Pty Ltd
  • You are solely responsible for how you use or rely on Generated Content
  • Generated Content should not be used as the sole basis for business, legal, or financial decisions

7. Intellectual Property

The Service, including its design, code, graphics, logos, and documentation, is owned by Hook Creative Studio Pty Ltd and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. Paid Plans, Subscriptions, and Refunds

HOOKiQ offers paid subscription plans (currently Pro and Business). Subscriptions are processed by Stripe, our third-party payment processor.

Pricing and GST. All prices displayed on the Service are in Australian dollars and exclusive of GST. Hook Creative Studio Pty Ltd is registered for GST. Goods and Services Tax (10%) is added at checkout for Australian customers in accordance with applicable tax law. International customers are not charged GST.

Billing cycle. Monthly subscriptions are billed every month. Annual subscriptions are billed once per year and currently include one month free relative to the equivalent monthly price. Subscriptions automatically renew at the end of each billing period using your saved payment method, unless cancelled before the renewal date.

Cancellation. You may cancel your subscription at any time via Settings → Manage Subscription, which redirects to the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period. You retain paid-tier access until that date, then the account reverts to the Free tier. We do not pro-rate refunds for unused time within a billing period that you chose to cancel.

Refunds. Subscription fees are generally non-refundable. However, nothing in these Terms excludes any non-excludable consumer guarantees you may have under the Australian Consumer Law, including the right to a remedy where a service is not delivered with due care and skill, is not fit for any disclosed purpose, or fails to meet a description. Requests for refunds in connection with such guarantees should be sent to hello@hook-iq.com.

Failed payments. If a renewal payment fails, Stripe will retry the charge automatically over a period of approximately three weeks. During this period your account remains on its paid tier. If all retries fail, your subscription is cancelled and the account reverts to the Free tier; you can re-subscribe at any time from Settings.

Price changes.We may change subscription prices with at least 30 days' notice via email. Price changes apply at the start of your next billing period. If you do not agree to a new price, you may cancel before the new price takes effect.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

11. Limitation of Liability

To the maximum extent permitted by law, Hook Creative Studio Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or any other applicable consumer protection legislation that cannot be excluded or limited by contract.

12. Indemnification

You agree to indemnify and hold harmless Hook Creative Studio Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
